About the customs broker

A legal customs broker may be a legal customs broker who has received a certificate of incorporation into the list of customs brokers as a customs broker of a government agency established in accordance with the legislation of Turkmenistan.

A customs broker carries out customs operations in accordance with this Code on behalf of the declarant or other relevant persons on their behalf

Relations between a customs broker and a representative are established on the basis of a contract in accordance with the Customs Code and other regulatory laws of Turkmenistan

Customs broker's rights

During the implementation of customs operations, a customs broker has the same rights as the rights of a person who is authorized to represent his interests in interactions with customs authorities.

A customs broker has the right to act as a guarantor before the customs authorities for the fulfillment of the obligations of the person he represents to pay customs duties and taxes, if it is required to ensure their payment in accordance with this Code.

The customs broker has the right to request and receive documents and information from the person necessary for customs clearance, including commercial, bank or other confidential information protected by law.

As a condition of entering into a contract with a person, the customs broker has the right to specify the requirements for ensuring the fulfillment of the obligations of that person in accordance with the civil legislation of Turkmenistan.

Duties and Responsibilities of a Customs Broker

The customs broker's duties during customs clearance are conditioned by the requirements and conditions set forth in this Code regarding customs operations necessary for placing goods under customs regulations and other customs procedures.

If stipulated in the contract with the representative, the customs broker shall pay the customs duties and taxes and shall be responsible as the declarant for the payment of the customs duties and taxes due.

Information that constitutes commercial, banking or other confidential information obtained from the agents, as well as other confidential information, must not be disclosed or used for private purposes by the customs broker and its employees, and must not be disclosed to other persons.

The customs broker is obliged to keep a report on the goods for which customs operations are carried out and to report on the customs operations carried out at the request of the customs authorities.
